STATE BOARD OF RESPIRATORY CARE

Created as the North Dakota Respiratory Care Examining Board by the 1985 legislature, the Board was established to adopt rules for the organization and to examine, license, and discipline registered respiratory and certified respiratory care practitioners. Since creation the Board has consisted of seven members appointed by the Governor for three-year terms. Initially the Board included two registered respiratory care practitioners and two certified respiratory care practitioners selected from lists submitted by the North Dakota Chapter of the Dakota Society for Respiratory Therapy. One physician, selected from a list submitted by the North Dakota Medical Association, also served and the two remaining members represented the public. Board members could serve for two complete successive terms and they could not be reappointed. Annually a Chairman is selected by the Board membership (S. L. 1985, Ch. 493).
Changes to the Board came in 1995 when the Board was renamed the State Board of Respiratory Care. Also the Legislature authorized the Board to license temporary respiratory care practitioners (S. L. 1995, Ch. 420). A registered respiratory care practitioner was issued a licensed by the Board to practice the profession, and the certified respiratory care practitioner was licensed to practice under supervision of a physician or a registered respiratory care practitioner. In 2001 the Legislature gave the name of respiratory therapist to both categories of practitioners. The law also stipulated that licenses for temporary respiratory therapists could not be renewed (S. L. 2001, Ch. 389).
In 2005 the Board was required to license the polysomnographic technologist and add to the Board one technologist from a list of names submitted to the Governor by the Association of Polysomnographic Technologists. This legislation also reduced the general public representative to one (S. L. 2005, Ch. 371).
CHRONOLOGY
1985 Created as the North Dakota Respiratory Care Examining Board to provide for licensure and regulation of respiratory care practitioners (S. L. 1985, Ch. 493).
1995 The Board name was changed to the State Board of Respiratory Care. The Legislature authorized the Board to license temporary respiratory care practitioners. The organization (North Dakota Society for Respiratory Therapy) that served as a consultant and submitted names for appointment to the State Board became known as the North Dakota Society for Respiratory Care (S. L. 1995, Ch. 420).
2001 The name respiratory care practitioner was changed to respiratory therapist and the State Board was no longer required to consult with the North Dakota Society for Respiratory Care before adopting or changing rules (S. L. 2001, Ch. 389).
2005 The Board was required to license polysomnographic technologists (S. L. 2005, Ch. 371).
2011 Legislation changed several sections of Century Code [NDCC 12-60-24 and NDCC 43-42] concerning the State Board of Respiratory Care and criminal history record checks for individuals licensed by the Board. The Board required any applicant or licensee to submit to a statewide and nationwide criminal history record check. The national criminal history record check was conducted in the manner provided by [NDCC 12 - 60 - 24]. All costs associated with obtaining a criminal history record check were the responsibility of the applicant or licensee (S.L. 2011, Ch. 327).
2013 Several changes were made to the Century Code including language cleanup and added definitions such as "Polysomnography" the practice of attending, monitoring, and recording physiologic data during sleep for the purpose of identifying and assisting in the treatment of sleep-wake disorders (S.L. 2013, Ch. 333).
2017 Changes to the Century Code related to licensing procedures for respiratory care and polysomnographic licensure. The term eardiorespiratory replaced cardiopulmonary systems (S.L. 2017, Ch. 293).
